Use the building contract’s own timeline
People often remember a cooling-off rule from a property purchase and apply it to a building contract. That is a risky shortcut. Consumer Affairs Victoria’s building-contract checklist anchors the five-business-day period to receipt of the copy signed by the builder. Capture that receipt event separately from your signature. Your practical record should include the complete signed document, covering email or portal notification, attachments and actual date received, so a lawyer can assess the deadline from evidence rather than recollection.
Do not use the calendar as a substitute for advice
A spreadsheet can remind you that a deadline may exist; it cannot decide whether the right applies or whether notice was served effectively. Ask the building lawyer to calculate the final day for this contract and identify any public holiday or receipt issue. Preserve the original messages and version history. If a later copy arrives with changed schedules or specifications, show both versions to the lawyer. Do not reset your own clock merely because a file was renamed or a builder sent a second email.
Check exclusions before relying on the right
The current CAV checklist identifies exclusions involving pre-signing lawyer review and a previous same-terms contract cooled off for the same home or land. These are reasons to obtain a precise answer, not reasons to avoid legal help. A building lawyer may find and negotiate a material risk before you sign. Record whether the contract was reviewed, what version was reviewed and any earlier cancelled agreement. Do not assume a generic cancellation paragraph guarantees an available statutory right in every situation.
Keep announced reform separate from today’s contract
CAV’s reform announcement says new domestic building-contract laws will take effect by 1 December 2026. That announcement is not permission to apply every future protection to a November contract. Ask the lawyer to verify commencement and transitional rules if signing is delayed or the agreement is replaced. Record the advice date and contract version. The point is to know which regime governs the decision in front of you, rather than combining a current checklist and a reform headline into a rule that neither states.
Resolve the commercial concern while time remains
If the concern is an incomplete specification, uncertain site cost or missing drawing, give that issue to the lawyer immediately. Identify the document, why it matters, what answer would resolve it and the date needed. Do not wait until the final afternoon to request basic clarification. The builder’s willingness to discuss an issue does not itself extend a legal deadline. Ask the lawyer whether a negotiated amendment, agreed extension or formal withdrawal is appropriate; your job is to supply accurate information promptly.
Serve a notice through an authorised method
When withdrawal is the advised course, ask the lawyer to use the required written notice and confirm how it must reach the builder. Keep proof of delivery with the signed contract. A casual message to a salesperson may not satisfy the contract’s service requirements. Record who sent the notice, to whom, when and by which method, and preserve any acknowledgment. Avoid sending conflicting messages from several team members. The aim is a clear, evidenced instruction handled by the person responsible for its legal effect.
Worked decision: the signature dates differ
Suppose you sign on one day and receive the builder-signed copy later. Your intake register should show both events, the attached schedules and the evidence of receipt. If a cost concern then emerges, the lawyer can test applicability and timing without reconstructing the inbox. Keep deposit recovery and approved incidental costs as a separate reconciliation; do not budget for an automatic full refund. Ask for the basis of any deduction and retain receipts. A cancellation decision and its cash consequence are related but distinct controls.
TPC deal lens: make the next step easy
You are not expected to solve this yourself. Send the lawyer one complete folder with the contract versions, receipt messages, earlier agreements and the commercial issue needing a decision. Ask for a clear answer about applicability, deadline, service and expected deposit treatment. Key takeaway: the useful starting point is a reliable receipt record and current advice. Your turn: could someone opening your project file today identify the exact builder-signed version you received, when it arrived and who confirmed the response deadline?

Frequently asked questions
Is this the cooling-off period for buying land?
No. This guide concerns Victorian major domestic building contracts. Land-sale rules are a separate issue.
What receipt should I preserve?
The copy signed by the builder, all schedules and the message or portal evidence showing when you received it.
Should I avoid a lawyer to preserve cooling off?
No. Obtain pre-signing advice and ask the lawyer to explain the applicable rights and exclusions.
Can I apply the announced December reforms now?
Have the lawyer verify commencement and transitional rules for the actual contract; an announcement alone is not enough.
Can a message to the salesperson end the contract?
Do not assume so. Use a lawyer-confirmed written notice and authorised service method.
