Approved yield still needs usable time
A sales listing may promote an approved subdivision without saying how much of its approval period remains. Before attaching value to those lots, request the decision notice, approved plans, conditions, changes, extension decisions and relevant correspondence. Record the application reference and the exact parcels covered. Do not calculate the deadline from the date printed on an advertising brochure. Your acquisition question is whether the remaining programme can reach the applicable milestone using the approval as it actually stands.
Identify the approval and its lapsing test
The Queensland development-assessment overview explains reconfiguring a lot and the concept of approval currency. The detailed rules sit in sections 85–87 of the Planning Act 2016. For the reconfiguration component, section 85 addresses giving the relevant plan to local government within the stated period or the statutory default. Do not import the substantial-start test for a different component into a subdivision assumption. Have the planner identify the exact operative trigger and period for this approval.
Reconstruct the history before counting days
Ask the planner to build a dated chronology: original approval, when it took effect, each change, each extension and any applicable statutory notice. Mark the evidence supporting each step. A changed plan does not, by itself, prove the whole clock restarted. Combined approvals may involve different components and dates. If a vendor says time was extended, request the instrument or decision and verify what it covers. Preserve contradictory records for resolution instead of selecting whichever date gives the longest runway.
Treat historical relief as evidence to check
Queensland has previously issued extension notices. The official 2022 extension factsheet explains a particular historical notice and its eligibility window; it is not a new blanket extension for every approval today. Give such material to the planner to assess against the approval history. Do not add an extra year merely because a search result mentions extension relief. Ask for a current written explanation of the resulting date and any unresolved legal question.
Work backwards from the required milestone
Once the date and trigger are confirmed, the surveyor and civil engineer should map the work needed before the relevant plan can be submitted. Include outstanding designs, authority requirements, works, inspections, supporting documents and the local submission requirements that actually apply. Put realistic durations and dependencies beside them. Keep the statutory milestone distinct from eventual registration of titles and lot settlement. A programme that reaches one of those events does not automatically prove it satisfies all the others.
Use a two-case acquisition test
Imagine a buyer receives an older two-lot approval and a contractor’s proposal to start civil works shortly after settlement. The buyer should compare two cases: delivery within the confirmed remaining period and delivery dependent on an extension. Ask the team to identify which approvals and documents still gate the plan milestone in each case. Carry the extra consultant work, holding time and possible redesign exposure into the conditional case. If the remaining time is too tight, get legal advice on an acquisition condition rather than pricing an unconfirmed extension as a completed fact.
TPC deal lens: an extension request is another decision
Section 86 provides for an extension application before lapsing, with the actual process and decision requiring review. Seek advice early enough to prepare a proper request; do not wait until the final day or assume the requested period will be granted. Keep the application, receipt, decision and effect on the programme together. Key takeaway: approved lots have commercial value only alongside a workable, evidenced delivery pathway. Your turn: what document proves the currency date on which your acquisition model currently relies?
Approval-currency acquisition checklist
- Collect the original decision, approved plans and every change and extension.
- Have the planner confirm the operative date and lapsing trigger for each component.
- Ask the surveyor and engineer to map prerequisites to the plan milestone.
- Separate confirmed remaining time from any extension-dependent programme.
- Seek advice on an acquisition condition where the currency evidence remains unresolved.

Frequently asked questions
Does starting earthworks always preserve a subdivision approval?
Do not assume that. Ask the planner to identify the specific statutory trigger for each approval component, including the reconfiguration plan requirement.
Does changing an approved plan reset its currency?
Do not assume so. Obtain a dated chronology and a planner’s explanation of what each change or extension actually did.
Can I rely on an old statewide extension announcement?
Only if the planner confirms the actual notice applies to this approval and calculates its effect from the evidence.
Who should check whether the plan milestone is achievable?
The planner should coordinate with the cadastral surveyor, civil engineer and assessment manager on the actual prerequisites and programme.
What if an approval may already have lapsed?
Treat its value as unresolved and obtain planning-law advice before acquisition. Do not promise delivery or treat an extension request as a revival.
