Victoria Owner-Builder Eligibility: Test the Delivery Strategy Before Budgeting Savings

Managing trades yourself is a regulated responsibility. Check whether the proposed project and your intentions fit the Victorian owner-builder route.

Put eligibility before the margin line

A feasibility can look better if it removes a builder’s margin and assumes the owner will coordinate the trades. That is a proposed delivery method, not an automatic saving. The BPC eligibility guidance requires an applicant to meet defined conditions, including not being in the business of building and residing or intending to reside in the dwelling, subject to the stated small-second-dwelling exception. If your base strategy is a commercial build-and-sell project, do not assume that calling yourself an owner-builder makes the route available. Describe the actual intention to the regulator.

Define exactly what you plan to do

Prepare a short scope with the land ownership, proposed dwelling, associated structures and work packages. Identify whether the project is a new home, alteration or another type of work. Do not combine several possible schemes into a vague application description. Your building surveyor needs to understand the actual building and your intended responsibilities. If the concept changes from retaining a home to multiple dwellings, revisit the delivery assumptions before tender comparisons or funding discussions rely on them.

Review the project and applicant together

BPC lists the applicant and project criteria, including ownership, a single domestic dwelling or associated work, training and prior owner-builder history. Its guidance also identifies work owner-builders cannot themselves carry out, including demolition, subfloor work and relocating a home. Put those issues in a question schedule for BPC and the surveyor. Eligibility attaches to the real circumstances; a friend’s approval for a different project cannot settle your application. Do not interpret a limited exception as permission to disregard the remaining requirements.

Cost your own management honestly

The BPC description of the role makes the owner responsible for supervising or undertaking work, permits and regulatory compliance. Its cost guidance includes labour and materials at the estimated cost of engaging a registered builder. For your feasibility, separately allow for scheduling, trade coordination, access, protection of completed work, inspection bookings and document control. Unpaid personal time still has a practical limit. If you cannot attend when a delivery fails or an inspection identifies a defect, identify who can manage the response and how that service will be funded.

Do not sign a role you have not accepted

Before any permit paperwork names you, review who is actually directing the work and who carries the contractual obligations. Ask the construction lawyer to explain the effect of the proposed arrangement, particularly if a contractor wants you to sign as owner-builder while they run the project. Obtain advice on the correct delivery structure rather than choosing a label to fit a quote. The permit role, trade contracts, insurance enquiries and day-to-day management plan should tell a consistent story.

Compare two complete delivery options

As a worked decision exercise, compare an eligible owner-managed single-home project with a registered-builder proposal for the same drawings. The first column needs realistic management time, trade interfaces, inspections, defect follow-up and contingency. The second needs the builder’s inclusions, exclusions and contract responsibilities. Use the same finish, site conditions and completion requirements in both. If the owner-builder option depends on free supervision, unavailable skills or an unconfirmed eligibility exception, show that as unresolved rather than booking a saving. Neither column is a quote until the responsible parties confirm it.

TPC deal lens: choose a lawful, workable role

Create a release record containing the confirmed project description, BPC eligibility response, surveyor’s permit advice and lawyer’s delivery review. Keep later-sale obligations on a separate advice line rather than assuming your responsibilities end at completion. You are not expected to settle eligibility law yourself; your role is to disclose the facts accurately and commission the answer. Key takeaway: establish that the delivery route fits both the person and project before adjusting the budget. Your turn: which management responsibility would remain uncovered if you were unavailable for a fortnight?

Your decision checklist

  1. Describe the actual intended residence, project and delivery role to BPC.
  2. Ask the surveyor to confirm permit and inspection responsibilities.
  3. Cost management time and trade interfaces against an equivalent builder proposal.
  4. Obtain legal advice before accepting an owner-builder role in paperwork.

Frequently asked questions

Can every developer choose to be an owner-builder?

No. Victorian eligibility conditions apply to the applicant and project. Ask BPC about the actual intended use and delivery strategy.

Does a certificate of consent replace a building permit?

No. Ask the registered building surveyor to confirm the required permits, inspection stages and completion evidence.

Can I value the work only at my cash purchases?

BPC guidance refers to labour and materials at the estimated cost of engaging a registered builder. Confirm the applicable valuation with your surveyor.

Does the small second dwelling exception remove all conditions?

No. An exception to a stated criterion should not be read as a blanket exemption. Obtain BPC confirmation.

What should I compare with a builder’s price?

Compare complete and equivalent scope, including management, inspections, trade interfaces, rectification responsibilities and realistic contingency.
