Buying Reserved Land in WA: Do Not Price an Assumed Government Buyout

A region-scheme reservation can affect a purchase strategy without guaranteeing when the WAPC will buy, or that a new buyer inherits a compensation entitlement.

A reservation is not a settlement date

A listing may describe a future road or public-purpose reservation as though a government purchase is an easy exit. The WA Government’s WAPC acquisition guidance says reserved land can generally remain privately owned until needed and that acquisitions operate on a long-term strategic basis. An acquisition scenario therefore needs evidence about the actual reservation and current position. Do not insert a government sale into the base cash flow simply because a map shows a public purpose.

Confirm which instrument affects which land

Give the planner the title, lot details and proposed purchase strategy. Ask for the current region-scheme extract, the reservation description, affected area and the date information relevant to further enquiries. If only part of a lot appears affected, have the planner explain the implications for the remaining concept rather than treating the entire parcel as either unrestricted or unusable. Keep local planning controls separate from the regional reservation. A map screenshot is a starting reference, not a legal opinion about the buyer’s rights.

Separate ownership from compensation

The WAPC’s published options identify circumstances in which compensation for injurious affection may arise and state an ownership-at-first-reservation requirement for the claims described. This is a critical purchase distinction. Ask the property lawyer to investigate the ownership history, operative instrument and relevant statutory provisions before deciding whether any right exists or can benefit your transaction. Do not assume that paying for the land transfers every expectation the seller describes. A contract recital and an agent’s estimate should be tested against the actual legal position.

Keep an offer to sell distinct from acceptance

The guidance also says consideration of a purchase is subject to acquisition priorities and available funds. Offering land to the WAPC is therefore different from holding an accepted, enforceable purchase arrangement. If that exit is important, ask the lawyer what written commitment would be needed and ask the relevant authority about the actual property. Until the evidence is obtained, keep timing and proceeds conditional. Do not use an unanswered enquiry as proof of either refusal or an imminent purchase.

Ask the valuer the right question

Brief the valuer using the confirmed reservation and legal assumptions. Explain whether you need an acquisition decision, a finance valuation or a scenario for discussion with the authority; those questions should not be silently mixed. Ask for the basis, limitations and date of any opinion. Even where official acquisition guidance describes a valuation approach, a reader cannot calculate their own entitlement by removing a discount from the asking price. Avoid borrowing a neighbouring transaction as a guaranteed rate for this parcel.

A two-exit feasibility example

Suppose a buyer intends to hold an existing dwelling while waiting for a public-purpose purchase. Build one scenario using the currently supportable private-market holding and exit assumptions, and another clearly conditional on the proposed authority transaction. Include holding costs, maintenance, finance expiry and the effect of an uncertain end date. Ask whether the project remains fundable without the hoped-for acquisition. If it does not, the missing commitment is central to the purchase decision; it cannot be hidden in a general contingency percentage. No particular rent, price or timing is assumed in this example.

TPC deal lens: buy only the supported position

Assemble a purchase note with the reservation evidence, planner’s concept advice, lawyer’s rights assessment, valuer’s assumptions and authority correspondence. Mark each claimed benefit as confirmed, conditional or unsupported. You are not expected to resolve planning-compensation law yourself. Commission the relevant specialists before approving an offer that depends on it. Key takeaway: reservation, compensation and acquisition are related but separate questions, each needing its own evidence. Your turn: if the authority purchase did not occur during your loan term, would the holding strategy still work?

Your decision checklist

  1. Confirm the current region-scheme instrument and affected area.
  2. Have the lawyer examine ownership history and the claimed right.
  3. Separate an authority enquiry from a committed acquisition.
  4. Test the holding strategy without the hoped-for buyout.

Frequently asked questions

Does reserved land have to be sold immediately?

The WA guidance says it can generally remain privately owned until needed for the public purpose. Confirm the actual property position.

Does a new buyer automatically receive compensation rights?

Do not assume so. The published options include ownership-at-first-reservation conditions; obtain legal advice on the specific right and transaction.

Will the WAPC buy whenever I ask?

Its guidance makes consideration subject to priorities and available funds. A request is not an accepted purchase arrangement.

Who confirms the mapped reservation?

A WA town planner should confirm the operative region scheme, affected area and development implications using current information.

What should the feasibility assume?

Use supportable holding and exit assumptions and show an uncommitted authority acquisition as a separate conditional scenario.
